Democrats are trying to systematically unwind the Second Amendment.
Some even openly admit it.
But anti-2A zealots were furious after one court ruling.
Joe Biden and Kamala Harris promised to be the most anti-gun administration in history, and the Democratic Party has taken their lead.
Deep-blue jurisdictions have made a point of passing ever-increasing gun control legislation, putting the onus on the courts to strike down the laws.
And a judge just struck down New York City’s gun licensing law, deeming it unconstitutional.
The law gave police departments broad grounds to deny gun licenses.
Federal judge says not so fast
U.S. District Court Judge John Cronan said that the law violated citizens’ Second and Fourteenth Amendment rights.
Cronan ruled that an applicant’s lack of “good moral character” or a nondescript “other good cause” to deny a license were too discretionary.
Cronan wrote, “The provisions fail to pass constitutional muster because of the magnitude of discretion afforded to city officials in denying an individual their constitutional right to keep and bear firearms, and because of defendants’ failure to show that such unabridged discretion has any grounding in our nation’s historical tradition of firearm regulation.”
New York is one of the worst states in the country for gun rights, consistently ranking in the 40s in the Cato Institute’s Freedom Index.
Why it matters
While Democrats claim they simply want “commonsense” gun laws, others state that their aim is to render the Second Amendment obsolete.
Charles Blow of the New York Times wrote, “The truth that no one wants to tell — the one that opponents of gun safety laws understand and the reason so many of them resist new laws — is that no one law or single package of laws will be enough to solve America’s gun violence problem. The solution will have to be a nonstop parade of laws, with new ones passed as they are deemed necessary, ad infinitum…Individual laws, like federal universal background checks and bans on assault rifles and high-capacity magazines, will most likely make a dent, but they cannot end gun violence. Invariably, more mass shootings will occur that none of those laws would have prevented.”
Blow said what most Democrats won’t; he wants to pass an endless string of gun laws until gun rights have effectively vanished.
Laws like the one just challenged in New York are a reminder that gun rights advocates have to remain vigilant.
